The contract made by you on-line with us incorporates these terms and conditions, which shall prevail over any and all terms and conditions, proposed by you.

1. Product Specifications:
1.1 We and our suppliers have a policy of continuous product development and reserve the right to amend the specifications of any goods or products without prior notice in relation to future sales.
1.2 All our oak furniture is made from quality natural wood and accordingly appearances may vary. Certain degrees of filler will be used on oak furniture this is common and very much part of the manufacturing process.
1.3 The majority of our Oak products are sold fully assembled, however on occasions certain pieces will need minimal assembly, this has been deemed fit to protect the item in carriage. Other larger items like wardrobes and showers are not built to allow access to the property.

2. Measurements:
2.1 We will not accept any liability for any extra costs incurred by you as a result of incorrect or incomplete measurements or information supplied by you, or minor alterations made by the supplier.
2.2 All dimensions specified by us are approximate.

3. Prices:
3.1 All prices include VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
3.2 Goods are delivered on weekdays directly to your home address. If you live within the UK mainland, the delivery will be free of charge however any cost of return of non faulty items will be with the customer. We will use 2 methods of carriage which we will determine on purchase. On larger or multiple items you will receive a call to arrange a convenient delivery date. However for smaller items a parcel carrier may be used, the carriers will not call you if this method is chosen, however they will leave a card for you to contact them to arrange the completion of delivery.
3.3 We will not be bound to honour any prices, where we have indicated to you subsequently that the prices displayed have been displayed in error. In these cases a refund will be offered.

4. Payment:
4.1 You must pay by credit, charge or debit card at the time of order. The price of any product is the price in force at the date and time of your order. You undertake that all details you provide to us for the purpose of purchasing products which may be offered by us on our website will be correct; that the credit card or debit card which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any products. We reserve the right to obtain validation of your credit charge or debit card details before accepting your order.
4.2 Payment will be taken in full at the time of the order.
4.3 The contract shall not have been concluded until we have completed all of the following steps: we have received your valid credit card charge or debit card payment details, we have accepted your on-line order and sent you confirmation of receipt of your order by return e-mail to the address you have given us during the registration procedure and on ordering and then we dispatched the goods to you.
4.4 We are entitled to refuse any order placed by you.

5. Delivery:
5.1 We are only able to deliver on-line orders to you if you have a permanent address on the UK mainland.
5.2 We will Endeavour to fulfil your order by the date set out in the e-mail or phone conversation by which we confirmed your order. Where this e-mail did not contain such a date we shall endeavour to fulfil your order within the time-scales advertised on the individual products on your order.
5.3 Orders totalling less than 30kg may be dispatched by post or courier.
5.4 Delivery is only available on a midweek day from 9am - 6pm. Larger items will arrive on a pallet to further protect the goods and will be delivered by a pallet truck to your door. With heavy items you may need help to bring your purchase indoors as the driver is only responsible for delivering the pallet to your door.
5.5 If you are unable, for whatever reason to take delivery of your goods on the pre-arranged delivery day and we have already dispatched your goods, or we are unable to deliver the goods due to there being no safe means of access to the place of delivery we shall be entitled to charge you to rearrange the delivery of your item or cancel your order and refund your payments less an aborted delivery fee levied by our carriers, a return charge will also be made per item. Although delivery is free it is subsidised by ourselves to a third party company, if a change of mind/return has been requested which is not a fault or damage we reserve the right to charge all delivery costs incurred by ourselves for the cancelled transaction. This includes all delivery charges and return fees from our courier.
5.6 The return charge mentioned will be applicable immediately after the items have left our warehouse, i.e. if the order is cancelled after we have despatched the item but before delivery to the final destination, the return charge levied by our carriers will still be applicable.
5.8 If our carriers accidentally damage goods in the course of delivery our liability for that damage is limited to the repair, replacement or refund of the goods or the value thereof.
5.9 Time of delivery is not of the essence in these terms and conditions. We will not be liable for any loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of ClickOak.co.uk or any reasonable rescheduling of delivery.

6. Returns, Refunds and Your Right to Cancel:
6.1 You have the statutory right to return any products you have purchased within ten (10) working days of delivery for any reason (including if you simply change your mind). To do so you must notify us in writing or other durable medium (including email) within those ten (10) working days. You will then be entitled to a refund from us, which will be paid within thirty (30) days of your notice of cancellation. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided (please note that stools cannot be built if you wish to return them within the 10 day money back guarantee). Although delivery is free it is subsidised by ourselves to a third party company, if a change of mind/return has been requested which is not a fault or damage we reserve the right to charge all delivery costs incurred by ourselves for the cancelled transaction. This includes all delivery charges and return fees from our courier. The general rule is that the cost of returning items after they have been dispatched will be £40 per item for return to a maximum of £60 for multiple items.
6.2 After this 10 day period has expired if we receive no such notification the customer will be deemed to have accepted the items as satisfactory.
6.3 To arrange a return of any of our goods we must receive photographs of any defects/problems which may be present so the courier arrangements can be made. Without these you as the customer are not protected for any further damage which may occur during return transit and would be charged accordingly upon its return.
6.4 If we deliver incorrect or damaged goods, or in the event that you discover any defect in the goods for which you require compensation or other remedy, you must report this within 24 hours of the date you receive them, or as soon as possible thereafter by emailing us. Please keep the products purchased in a saleable condition and retain the original packaging in the condition it was provided. We reserve the right to refuse return of items should the original packaging not be available to allow the safe return via our carriers. Should it be deemed impractical to offer a replacement, redelivery or re-selection of any damaged or faulty items we reserve the right to offer an allowance against a repair, or alternatively a refund for your purchase. Any non faulty items returned will always be returned at the expense of the customer.
6.5 Any collections arranged for goods for any reason would be carried out Monday to Friday only. If your product arrives on a pallet then collection day will be given but a time cannot be given as an all day call is needed. As per the delivery conditions the driver is not responsible to load/unload the goods onto/off the pallet only to place the pallet on the vehicle. Other courier collection for smaller items (under 30kg) have an allocated time slot which can be arranged with you and ourselves over the telephone.
6.6 We will not be liable for any damage or loss resulting from repairs attempted by you or third parties.

7. Guarantees and Claims under Guarantee:
7.1 The provisions of this clause 8 and clause 9 below, apply in addition to your statutory consumer rights in relation to faulty or misdescribed products. These rights are not affected by the guarantee.
7.2 We guarantee all products against faulty workmanship and/or faulty materials for a minimum period of 12 months from the actual date of delivery.
7.3 These guarantees do not cover fair wear and tear and natural characteristics of wooden products including movement in wooden products; neglect; abuse or misuse of your goods in failing to follow correct care procedures; loss or damage due to fire, smoke, water, lightning, sunlight, weather, rusting, corrosion, theft or explosion; accidental damage or loss or damage caused by a third party.
7.4 With our oak furniture on rare occasions due to extreme climate changes in shipping you may find slight swelling on doors or drawers thus making them stiff to open, it is important not to return or refuse the item if this is case. Usually this problem will rectify itself in a matter of days once the timbers adjust to their new environment, alternatively you may find simply swapping drawers will remedy this. On rare occasions the movement may not settle and you may need to sand or shave a small amount from a drawer or door, please shave from the bottom of the drawer front or the side of a door as this will not be noticeable with regards to the look of the furniture. A simple touch of Danish oil will then protect the adjustment made. Please could we ask you to bear in mind that you are purchasing these natural products with slight timber movements a rare possibility. Therefore stiff drawers or doors will not be deemed as defective or faulty and any necessary simple adjustments needed would be need to be undertaken by the customer. If you wish not to undertake any adjustments needed we will of course offer a refund under our full 7 day money back offer.
7.5 Please avoid aerosol furniture polishes such as (Mr sheen) etc, this will dry out the timbers. Simply buff with a dry lint free cloth for best results. For your furniture to stay in its best condition it will require treating approx every 3 months with Danish oil, this is inexpensive and available from any good DIY store. We recommend you treat your furniture immediately on delivery as your item may have been in transit for some time, failure to treat oak items as instructed could result in drying and cracking.
7.6 Our bathroom and hot tub ranges are all covered by a 1 year parts and components warranty with us. In the unlikely event of any problem developing, parts and simple replacement instructions will be sent out free of charge.
7.7 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered products over and above the value of the goods themselves. This does not affect your statutory rights.

We will use our best endeavours to rectify any errors, as swiftly as possible but we cannot be responsible for any losses incurred.
